Badass Human Run - Participant Waiver, Assumption of Risk, and Release of Liability Agreement

PLEASE READ THIS DOCUMENT CAREFULLY BECAUSE IT HAS LEGAL EFFECT.

By registering for and participating in the Badass Human Run, you acknowledge and agree to the following:

Assumption of Risk

I understand that participating in the Badass Human Run involves inherent and significant risks, including but not limited to physical exertion, obstacles, water hazards, falls, slips, extreme weather, and the actions of other participants or third parties. These risks may result in injury (including serious injuries such as fractures or traumatic injuries), permanent disability, or death.

I acknowledge and assume all risks, both known and unknown, including those arising from negligence on the part of the event organizers, volunteers, sponsors, or other participants, except for cases of gross negligence or willful misconduct.

Waiver of Liability and Release of Claims

In consideration of being allowed to participate in the event, I waive any and all claims against the event organizers, volunteers, sponsors, and any associated parties (collectively "Releasees") for injuries, death, damages, or other claims arising from my participation, except in cases of gross negligence or willful misconduct.

This includes but is not limited to claims based on:

• Unsafe course conditions

• Failure to warn of known hazards

• Negligent event management or supervision

I fully and forever release and hold harmless the Releasees from any liability that may arise out of my participation in this event.

Medical Consent

I certify that I am physically fit and have consulted with a physician if necessary. In case of injury, I consent to medical treatment, and I understand I am responsible for any costs associated with such treatment.

Compliance with Rules

I agree to follow all event rules, including wearing appropriate gear and adhering to safety protocols. Failure to comply with these rules may result in disqualification without refund.

No Refund Policy

Tickets are non-refundable under any circumstances, including illness, injury, or event rescheduling. In the event of cancellation due to severe weather or unforeseen circumstances, participants may receive credit toward future events.

Force Majeure

The event organizers reserve the right to cancel or postpone the event due to circumstances beyond their control (force majeure), including but not limited to extreme weather, natural disasters, or government regulations. No refunds will be provided in such cases, but participants may receive credit for a future event.

Indemnification

I agree to indemnify and hold harmless the Releasees from any claims, damages, or liabilities arising from my conduct during the event, including harm caused to other participants, event staff, or property.

Use of Media

I grant permission for the event to use my image, likeness, and any photographs or videos taken during the event for promotional, advertising, or marketing purposes without compensation. This includes use across all forms of media, including but not limited to social media, print, television, and online platforms.

Governing Law and Dispute Resolution

This agreement is governed by the laws of [Your State]. All disputes arising from this agreement will be resolved exclusively through binding arbitration as per the rules of the American Arbitration Association.

Severability

If any part of this agreement is found invalid, the remaining provisions shall remain in full force and effect.

Indemnification and Defense By participating in the Badass Human Run, you agree to indemnify, defend, and hold harmless the event organizers, sponsors, volunteers, our third-party service providers, and their respective directors, officers, employees, and agents from and against any and all claims, damages, losses, and costs that arise from or relate to your participation in the event or your violation of these terms.
